When a person dies as a result of the unawareness of the medical staff. This include: negligence, carelessness. Wrongful death is the basis for a court case (wrongful death action) against the party or parties who caused the death filed on behalf of the family members who have lost the company and support of the dead.
This type of claim is different from a normal claim. Originally under the "law", a wrongful death claim did not exist based upon the reasoning that the claim died with the victim where there was no way to compensate him for damages.
